My Rewards Policy

PLEASE READ THESE CONDITIONS OF PARTICIPATION CAREFULLY. BY PARTICIPATING IN THE FIZZ “MY REWARDS” PROGRAM, YOU AGREE TO BE BOUND BY THESE CONDITIONS. IF YOU DO NOT AGREE WITH THESE CONDITIONS OF PARTICIPATION, PLEASE DO NOT PARTICIPATE IN THE FIZZ “MY REWARDS” PROGRAM. NO PURCHASE IS NECESSARY TO PARTICIPATE IN THE PROGRAM.
1. Enrolment and eligibility
The “My Rewards” loyalty program (the “Program”) is a rewards program offered by Fizz to its customers residing in Canada. Enrolment in the program is limited to individuals who have an active Fizz customer account. Employees, executives, directors, agents and representatives of Fizz and its affiliates are eligible to enrol in the Program, but may be excluded from certain promotions. You must be a legal resident of Canada to be eligible for enrolment in the Program.
2. Definitions of some Program components
Points: Points are the key element of the Program. They are given to underline the time you have accumulated as a Fizz customer, as an acknowledgement for each transaction (purchase, renewals, etc.) and to thank you for using and interacting with the services we offer. The points accumulated allow you to progress from one level to the next within the Program. Points cannot be exchanged or given to a third party. Points have no monetary value and we may change the number of points awarded for a given transaction at any time and without notice.
Levels: Levels are tiers achieved by Fizz customers when they reach the required number of points. The Program comprises ten (10) levels with a certain number of rewards (bonuses and/or gifts) attached to each one. The threshold for each level is subject to change without notice, which could result in an upward or downward correction for Program participants. The rewards associated with each level are also subject to change at any time and without notice.
Rewards: The rewards include all types of elements obtained under the Program, that is, bonuses, gifts & badges. The rewards offered remain at all times subject to change without notice.
Bonuses: Bonuses are rewards obtained when a certain level is achieved. They may be applied to the plan (mobile or internet) of your choice and may be changed at any time. When a bonus us changed during a billing period, the change will be taken into account only during the following period, unless indicated otherwise. Bonuses remain valid for a period of twenty-four (24) months after they were obtained. Bonuses are attached to your user account and cannot be exchanged or given to a third party. Bonuses have no monetary value and we may change the number of bonuses awarded at any time and without notice. The following chart applies to bonuses:
- A maximum of 1 bonus per plan may be applied between levels 1 and 2;
- A maximum of 2 bonuses per plan may be applied between levels 3 and 4;
- A maximum of 3 bonuses per plan may be applied starting at level 5.
Gifts: Gifts are rewards that may occasionally be sent by the Fizz team to Program participants. Gifts may be sent to all customers or form the subject of targeted mailings based on various criteria (level achieved in the Program, type of plan, city, postal code, etc.). Gifts may be in the form of products or services associated with Fizz, or be offered by selected third-party partners (in which case Fizz disclaims all liability and acts solely as an intermediary). If applicable, gifts have a specific expiry date and the reward associated with a gift also has a specific period of validity. Gifts cannot be exchanged or given to a third party. Gifts have no monetary value and we may change them at any time and without notice.
Badges: Badges are rewards offered to underline an important milestone in your Fizz experience. Among other things, they may be associated with Program bonus points. Badges remain at all times associated with your personal account and cannot be exchanged or given to a third party.
3. Progression in the Program
When your Fizz account is created, you immediately achieve the first level of the Program. Afterwards, you can obtain a certain number of points based on the type of plan to which you subscribe and the various actions you take at each stage of the Program, which will allow you to move from one level to the next. As long as you have at least one active service with Fizz, you will continue to accumulate points. The terms of progression are subject to change without notice.
With each level that you achieve, you normally receive one or more bonuses as well as one or more gifts.
3. Regression in the Program
If you deactivate all of your plans, you will switch from progression mode to regression mode in the Program. Therefore, rather than accumulating points, you will lose points. You will drop down one level at a time and will gradually lose the privileges and rewards associated with the levels lost. The stages of regression are as follows:
- At the end of the month following deactivation of your services, you will lose 25% of all your points as well as the levels associated with them.
- At the end of each subsequent month, you will lose 5% of your remaining points.
- Regression will continue until you reach Level 3, which is the bottom level of the Program.
From the moment you enter the regression mode, you may reactivate a service at any time to stop regressing and start progressing again in the Program. You will resume at your current level, with the rewards that are already in your account. The terms of regression are subject to change without notice.
4. Limitation of liability
To the fullest extent permitted by applicable law, we disclaim all warranties, whether express or implied, regarding your participation in the Program. We are not liable for any direct, indirect, special or punitive damages or monetary loss, even if we have been previously advised of the possibility of such damages, whether in an action for contractual, extracontractual or civil liability, or any other legal theory resulting from or in respect of the use, inability to use or performance of services or products offered and information or messages related to the Program or these conditions of participation. This limitation of liability clause shall apply notwithstanding any failure of any limited remedy available at law.
5. General conditions of the Program
We reserve the right, at any time and without notice, to close your account and/or end your participation in the Program if we believe, in our sole discretion, that you have breached these conditions of participation. If your participation in the Program is cancelled, all points accumulated in your account will be declared null and void. We also reserve the right to interrupt, cancel or terminate the Program at any time and without notice.
The entire content of the Program, including, without limitation, the texts, drawings, graphics, interfaces, or the selection and arrangement thereof is our property or the property of its indicated owner, and is protected by copyright law. It is strictly prohibited to copy, reproduce, publish, redistribute, transmit or use it in any manner whatsoever without our prior written consent.
In addition, all trademarks, registered or not, and all trade names used by Fizz in connection with the Program are our property or the property of the respective owners who have validly granted us the right and permission to use them.
These conditions of participation are governed by the laws applicable in the Province of Quebec, and any dispute shall be submitted to the competent courts of the Province of Quebec, in the district of Montréal. Should any of the provisions of these conditions of participation be deemed invalid by a court of competent jurisdiction, such invalidity will not affect the validity of the remaining provisions, as the invalid provision must be severed from the remaining provisions of these conditions of participation, which will remain in effect. If you suffer any prejudice whatsoever or if you disagree in any way with the provisions of these conditions of participation or with the Program, your sole recourse is to not participate in the Program.
