ENTRY RULES

 

  1. The contest Fizz Social Media Survey (hereinafter referred to as the “Contest”) is sponsored by Vidéotron Ltée, carrying on business as Fizz (hereinafter jointly referred to as the “Sponsor”). The Contest begins on February 23, 2023 at 12:00 pm, and ends on March 23, 2023 at 11:59 pm (EST) (hereinafter referred to as the “Contest Duration”). All times indicated are Eastern Standard Time (EST)

 

ELIGIBILITY

  1. The Contest is open to Québec residents aged 18 or over, excluding employees, agents and/or representatives of the Sponsor, its affiliates, its promotional and/or advertising agencies, partners and other service providers associated with the Contest as well as any person residing with, or who is a member of the immediate family of, such an employee, agent and/or representative. For the purpose hereof, “immediate family” refers to the father, mother, brother, sister, child, husband, wife or common-law spouse of such an employee, agent and/or representative.

 

HOW TO ENTER

  1. To enter the Contest, you must:

    1. Answer the Fizz Social Media Survey by clicking on the link found on our Facebook and Instagram social media channels as well as on the Fizz Forum between February 23, 2023 12:00 pm and March 23, 2023 11:59 pm. For successful and complete completion of the Survey, you will be asked to complete questions 1 through 11 in which you will be asked to select the appropriate answer regarding: your age, language, household type, social media usage, your favorite brands or companies, whether you are a member or non-member of the Sponsor, which social media channels you follow the Sponsor on, the main reason you follow the Sponsor, your content type preferences, and finally your comments (on the "Survey"). Upon successful and complete completion of the Survey, you will be prompted to enter your email address to complete your registration for the Contest.

    2. A contest participant may use only one valid email address to complete the Survey. Limit of one (1) entry per person.

    3. No purchase required.

 

DRAW

  1. Draws for the five (5) winners (each a "Winner" and collectively "Winners"), by random selection, will take place at the offices of the Sponsor, located at 612 Rue Saint-Jacques, Montreal, QC H3C 4M8. Specifically, the draws will be held on the following date and time:

    • Friday, March 24, 2023 at 12:00 pm.

     

  2. Limit of one prize per person per civic address per participant for the duration of the Contest.

  3. The odds that an entry is selected at random depend on the number of entries received in accordance with the Entry Rules herein.

 

PRIZES

  1. The five (5) Winners will each have the chance to select one (1) of five (5) prizes of approximately $100 CAD each, for a total approximate value of $496 CAD:

    1. A one-year subscription to SÉPAQ (value of approximately $96

    2. A Visa prepaid credit card (value of approximately $100)

    3. A Kombi gift card (value of approximately $100)

    4. A gift card from one of the following retailers: Simons, Uniqlo or Sport Experts (value of approximately $100)

    5. A KaseMe gift card (value of approximately $100)

(collectively and individually the/a "Prize")

All values listed herein are before taxes. It is understood that the Winners will have the opportunity to choose the prize of their choice from the above selection.

  1. The following conditions apply to the Prizes:

    1. The Prize is non-transferable, non-refundable, non-exchangeable and non-redeemable for cash; and

    2. The Sponsor will notify the Winners by email within seventy-two (72) hours of the draw of the receipt, selection and possession of their Prize. Following this message, each Winner will receive his/her prize or gift card by email. It is the responsibility of each participant to access his/her email regularly during this period. In the event that a Winner cannot be reached within three (3) days of the draw to confirm acceptance of the Prize for any reason, the Prize will be awarded in a new random draw;

    3. No credit or refund will be given if any portion or all of the Prize is not used in full. Use of the Prizes is governed by the terms and conditions of use of its respective issuer. Prizes are not redeemable for cash or cumulative with other offers. In particular, each Winner must comply with the other restrictions set forth on the back of the gift certificates; and

    4. Any Prize must be accepted as described in these Entry Rules and as awarded and may not be transferred, substituted for another prize or exchanged in whole or in part for cash. In the event that, for reasons unrelated to the Winner, the Sponsor is unable to award the Prize (or portion thereof) as described in these Entry Rules, the Sponsor reserves the right to award a Prize (or portion thereof) of equal kind and value or, at its sole discretion, the value of the Prize (or portion thereof) as indicated in the Entry Rules in cash; and

    5. In the event that a Prize may carry a warranty, the Winner acknowledges that the sole and exclusive warranty applicable thereto is that of the manufacturer, retailer and/or fabricator of the Prize, if any.

 

PRIZE CLAIM

  1. To be declared a Winner and receive the Prize, the participant whose entry is selected in the Prize draw must:

    1. Comply with the conditions of entry and eligibility set forth in these Entry Rules, including the conditions set forth in Section 3 hereof. Failure to do so will result in automatic disqualification and another draw will be held to determine a new Winner; and

    2. Be reachable by the Sponsor within three (3) days after the draw. It is each person’s responsibility to provide a valid email address where they can be reached. Should the Sponsor be unable to contact an entrant regarding one or more of the draws for any reason whatsoever within the three (3) days following the draw, the Sponsor will proceed with as many new draws as necessary from the entries received in order to award the Prize; and

    3. Accept the terms and conditions of the Prize for which he/she has been selected; complete and sign a Declaration and Release Form (the "Form") as provided by the Sponsor and return it duly completed and signed within two (2) days of receipt. Failure to return the signed Form within this time period will result in the selected entrant not being declared a Winner and receiving the Prize; and

    4. In the event that a person selected at random refuses to accept a Prize according to the terms herein, the Sponsor is released from any obligation toward this person with respect to the Prize.

 

GENERAL CONDITIONS

  1. All Winners release the Sponsor and its affiliates, their advertising or promotional agencies, and their shareholders, directors, officers, employees and agents, as well as any other party involved in the Contest (hereinafter referred to as the "Releasees"), from all liability for any damages they may suffer as a result of accepting or using the Prize or in connection with the Prize and the Contest. Before being declared a winner and receiving the Prize, each selected entrant agrees to complete and sign the Release Form, failing which he/she will not be eligible to receive the Prize.

  2. By entering or attempting to enter the Contest, any person releases the Contest organizers, their affiliates, advertising and/or promotional agencies, Meta Platforms, Inc. (Instagram and Facebook), and their employees, agents, and representatives from any and all liability for any damages that he or she may suffer as a result of participating or attempting to participate in this Contest.

  3. The Sponsor assumes no liability of any kind in case its inability to act results from a circumstance or situation that is beyond its control, or from strikes, lockouts or other labour disputes in its establishment or in the establishments of organizations and companies whose services are contracted for the Contest.

  4. By entering or attempting to enter the Contest, any person acknowledges that the promotion is in no way sponsored, endorsed, administered or associated with Meta Platforms Inc (Facebook, Instagram). You acknowledge that your entry into the Contest may be made through your Facebook account. By participating in the Contest in this manner, you agree that Meta Platforms Inc. and each of its representatives and agents assume no liability whatsoever in connection with the conduct of the Contest and that your participation in the Contest via such social media is governed by the respective social media rules of use.

  5. By entering the Contest, the Winner authorizes the Sponsor and/or their partners and their representatives to use, if required, his/her name, photograph, city, voice, likeness and statements regarding his/her Prize without compensation for advertising purposes or any other purpose deemed relevant, at their discretion and without limit as for the period of use, in any media and on a worldwide scale. Furthermore, the Winner consents to the publication of their first name and city of residence on the Contest website without compensation.

  6. The Releasees assume no liability for incomplete or incomprehensible contact information from the Contest participants. The Sponsor reserves the right to disqualify any entry that is incomplete, illegible, mutilated or that contains a human or mechanical error, and to draw another entry form.

  7. Any entry or attempted registration using a computer, electronic means or any other means contrary to the spirit of the Contest (e.g. hacking, mass emailing, etc.) shall automatically be disqualified and may be referred to the appropriate legal authorities. Any automated entry shall be identified and disqualified.

  8. The Sponsor assumes no liability for any problem including, but not limited to: a technical malfunction of the telephone network or lines, online computer systems, servers or providers, computer equipment, software or any other problem resulting directly or indirectly from a virus, computer worm, bug or failure while sending emails to the Sponsor for any reason, including, but not limited to, traffic on the Internet network or a website, or a combination of the two. The Sponsor and other Releasees cannot be held liable for any damage to participants’ computer hardware following their entry in the Contest.

  9. The Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this Contest, in whole or in part, in case an event, technical error, or human intervention corrupts or disrupts the administration, security, impartiality or normal course of this Contest as provided herein. In all cases, the Sponsor, advertising and promotional agencies, providers of services or prizes relating to this Contest, as well as their employees, agents and representatives, cannot be required to award more prizes than those stated herein or to award prizes other than provided herein. Furthermore, the Sponsor is not liable for technical errors or difficulties resulting from server, hardware, or software malfunction or alteration of participant modification of data actions, transmission, transmission problems, or loss or modification of data sent by participants.

  10. All decisions of the Sponsor or those of their representatives regarding the Contest are final and binding, subject to any decision by the Régie des Alcools, des Courses et des Jeux Du Québec in relation to matters under its jurisdiction.

  11. Any litigation as to the organization or conduct of a publicity contest may be submitted to the Régie des Alcools, des Courses et des Jeux for a ruling. Any litigation associated with the awarding of a prize may be submitted to the Régie des Alcools, des Courses et des Jeux only for the purpose of helping the parties reach a settlement.

  12. The names of the Contest Winners will be made available between 9:00 a.m. and 5:00 p.m. at the offices of the Sponsor, or no later than three (3) days after the draw, for a minimum period of ten (10) days following the draw date.

  13. Contest rules are available throughout the Contest Duration at the Sponsor’s offices at 612, rue Saint-Jacques in Montréal, Québec, and on the Sponsor Website.

  14. Any intellectual property and promotional material, Web pages and source codes are the property of the Sponsor or its affiliates. All rights reserved. Reproduction or unauthorized use of material protected by copyright or trademark without the express written consent of its owner is strictly prohibited. The Entry Forms are the property of the Sponsor.

In the event of any divergence between the English and the French version of theses Entry Rules, the French version shall prevail.

 

PROTECTION OF PERSONAL INFORMATION

  1. The personal information you provide to the Contest Sponsor in connection with this Contest is provided by you, voluntarily, to the Contest Sponsor. Personal information collected about participants in connection with this Contest is used for the administration of this Contest and is subject to the Privacy Policy (https://fizz.ca/en/privacy). No communications, commercial or otherwise, unrelated to this Contest will be sent to the entrant by the Sponsor, except as otherwise permitted by the entrant, if applicable, by checking the appropriate box at the time of completion of the Survey, if applicable, or as permitted under the Privacy Policy.
